Article 1 – Definitions

1.1 Cooling-off period: the period within which the consumer can exercise their right of withdrawal
1.2 Consumer: the natural person who does not act in the exercise of a profession or business and who enters into a distance contract with the entrepreneur
1.3 Cookie: a small text file containing information. The cookie remembers, for example, the consumer's login details and ensures that they remain logged in while using the site
1.4 Day: calendar day
1.5 Digital content: data produced and delivered in digital form
1.6 Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed to them personally in a way that allows future consultation and unchanged reproduction of the stored information
1.7 Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period
1.8 Entrepreneur: the natural or legal person who offers products, digital content and/or services remotely to consumers
1.9 Distance contract: an agreement whereby, within the framework of a system organised by the entrepreneur for the remote sale of products, digital content and/or services, up to and including the conclusion of the agreement, only one or more remote communication techniques are used
1.10 Force majeure: any circumstance beyond its control, which wholly or partly prevents the fulfillment of its obligations towards the consumer. Such circumstances include strikes, fire, business interruptions, energy disruptions, non-delivery or late delivery by suppliers or other engaged third parties, and the absence of any government permit. Force majeure also includes disruptions in a (telecommunication) network or connection or communication systems used and/or the internet site being unavailable at any time
1.11 Remote communication technique: means that can be used to conclude an agreement without the consumer and entrepreneur being simultaneously in the same room

Article 3 – Applicability

3.1 These general terms and conditions apply to all products, digital content and services and to every agreement concluded between the consumer and the entrepreneur
3.2 Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer
3.3 If the agreement is concluded electronically, the text can be made available electronically
3.4 In case of conflicting conditions, the provision most favorable to the consumer applies
3.5 If one or more provisions are invalid, the remaining provisions remain in force
3.6 Situations not covered will be assessed in the spirit of these terms and conditions
3.7 Ambiguities will be interpreted in the spirit of these terms and conditions


Article 4 – The offer

4.1 If an offer has a limited validity period or is subject to conditions, this will be stated
4.2 The offer is non-binding and can be adjusted
4.3 Products are described as completely and accurately as possible
4.4 Images and specifications are indicative
4.5 Colors may differ from reality
4.6 Every offer contains clear information about price, shipping and conditions
4.7 The content of Mystery products is a surprise and cannot be precisely determined in advance


Article 5 – The agreement

5.1 The agreement is concluded after the completion of data and payment
5.2 The consumer becomes the owner after full payment and delivery
5.3 The entrepreneur confirms the order by email
5.4 The entrepreneur ensures a secure web environment
5.5 Orders can be refused in case of risk
5.6 Delivery takes place within a maximum of 30 days
5.7 Delivery abroad may take longer


Article 6 – Right of withdrawal

6.1 The consumer has a 14-day cooling-off period
6.2 The period starts after receipt
6.3 Products must be handled with care
6.4 Returns must first be reported by email
6.5 Product must be returned within 14 days
6.6 Return costs are for the consumer
6.7 After the period, the right of withdrawal expires
6.8 Refund occurs within 14 days

Return shipment

After approval, you have 14 days to return the product.

  • Return costs are at your own expense
  • We recommend shipping with track & trace
  • The risk of return shipment lies with the customer

Refund

After receipt and inspection of the product:

  • You will receive the purchase amount back within 14 days
  • Refund will be made via the same payment method

Damaged or incorrect product

Have you received a damaged or incorrect product?
Contact us by email within
48 hours of receipt and include clear photos.

We always ensure a suitable and quick solution.

Due to the mystery nature of our products and hygienic reasons, opened products cannot be returned.
Scent experience is personal and does not constitute a valid reason for return.


Article 7 – Exclusion of right of withdrawal

7.1 Products whose seal has been broken cannot be returned
7.2 Opened products will not be accepted
7.3 Mystery products cannot be returned based on personal preference, such as scent.
7.4 Products specially assembled on request cannot be returned


Article 8 – The price

8.1 All prices are in euros and include VAT
8.2 Shipping costs are stated separately
8.3 Prices may change
8.4 Errors in prices do not give the right to delivery
8.5 Obvious errors are not binding on the entrepreneur
8.6 Discounts are only valid within the promotion period


Article 9 – Conformity and warranty

9.1 Products meet reasonable quality requirements
9.2 Defects must be reported within 3 days
9.3 The entrepreneur offers a suitable solution
9.4 Scent experience is personal and is not covered by warranty
9.5 Warranty expires with incorrect use


Article 10 – Delivery and execution

10.1 Orders are processed with care
10.2 Addressing is the responsibility of the consumer
10.3 Processing time is 1-3 business days
10.4 Delivery times are indicative
10.5 Delay does not entitle to compensation
10.6 In case of problems, the consumer will be informed
10.7 A replacement product can be delivered
10.8 Risk transfers upon delivery


Article 11 – Complaints procedure

11.1 Complaints must be reported within 7 days
11.2 The entrepreneur will respond within 14 days
11.3 The consumer must provide an opportunity for a solution
11.4 Disputes arise after 4 weeks
11.5 The entrepreneur will offer a suitable solution


Article 12 – Disputes

12.1 Dutch law applies
12.2 Disputes can be reported via the ODR platform


Article 13 – Retention of title

Ownership remains with the entrepreneur until full payment


Article 14 – Liability

14.1 The entrepreneur is not liable for indirect damage
14.2 Liability is limited to the purchase amount


Article 15 – Force majeure

The entrepreneur is not liable in case of force majeure


Article 16 – Privacy policy

16.1 The data provided by the consumer will be treated confidentially by the entrepreneur and will be used for the following purposes:
a. processing the order
b. payment thereof and delivery to the correct delivery address
c. promoting the user-friendliness of the site
d. being able to make (personalized) offers and promotions or provide relevant information or newsletters to the consumer
16.2 The entrepreneur observes the applicable privacy regulations and legislation
16.3 The entrepreneur does not sell customer data to third parties and will only make it available to third parties if they are involved in carrying out your order
16.4 Upon the consumer's first visit to www.minimysteryscoops.nl, the entrepreneur informs the consumer about cookies and asks for permission to place them. The consumer can opt out of cookies by setting his/her internet browser so that it no longer stores cookies. In addition, the consumer can also delete all information previously stored via his/her browser settings
16.5 The consumer has the right to correct or delete his/her personal data. The consumer must send an email for this purpose. The entrepreneur will respond to the consumer's request as soon as possible, but within the specified period of 4 weeks

Article 17 – Copyright

All content is the property of Mini Mystery Scoops. It is therefore not permitted to copy, distribute or otherwise use any information, photos, etc. from this webshop in any form without the prior written consent of the entrepreneur

Article 18 – Additional provisions

The entrepreneur reserves the right to amend these terms and conditions
